Consent is not required to purchase goods or services.

Other recognized opt-out commands include: QUIT, END, CANCEL, UNSUBSCRIBE, or STOP ALL.

We do not guarantee the delivery of SMS messages. Delivery depends on the network service of your wireless provider.
Beverly Tails is not liable for any delays, errors, or failures in message transmission or delivery.

We may disclose your information as required by law, to enforce our rights, or to protect our interests.
By signing up, you agree to provide accurate, complete, and truthful information.
Providing false or misleading information may result in termination of service and legal action.

8. Dispute Resolution

Any dispute, claim, or controversy between you and us—or between you and any third-party service provider acting on our behalf—arising out of or relating to these Terms, our Privacy Policy, or any related matter shall be resolved by binding arbitration in Michigan before a single arbitrator.
The arbitrator will apply Michigan law, excluding its conflict-of-law rules.
This agreement does not prevent either party from seeking provisional remedies in a court of appropriate jurisdiction.
This agreement involves interstate commerce, and the Federal Arbitration Act (9 U.S.C. §§ 1-16) governs the arbitration.

Class Action Waiver

To the fullest extent permitted by law, any proceedings—whether in arbitration or court—will be conducted only on an individual basis, not as a class, consolidated, or representative action.
If a claim proceeds in court rather than arbitration, both parties waive the right to a jury trial.

Arbitration Award

The arbitrator may award monetary damages and other remedies permitted under Michigan law but may not modify these Terms.
The arbitrator’s written decision (“Award”) is final and binding and may be enforced in any court with jurisdiction over the parties or their assets.

Arbitration Costs

Each party will share equally the arbitrator’s fees, facility costs, and court reporter expenses.
The prevailing party may be awarded reasonable attorneys’ fees and costs.

Confidentiality

Both parties agree to maintain confidentiality regarding all aspects of the arbitration, including hearings, evidence, and the Award, except where disclosure is legally required or necessary to enforce the Award.

9. Miscellaneous Terms

By agreeing to these Terms, you confirm that you have the necessary rights, power, and authority to do so, and that no other agreements conflict with these Terms.
Failure by either party to enforce any provision shall not constitute a waiver of rights.
If any provision of these Terms is deemed unenforceable, it will be adjusted to the minimum extent necessary, while the remainder remains valid.
We reserve the right to modify or update these Terms at any time. It is your responsibility to review them periodically.
Your continued participation after any changes constitutes acceptance of the updated Terms.
